How and why we use information
Information is used to respond to enquiries, arrange and provide driving tuition, monitor progress, prepare for tests, take payment, maintain business records, meet legal and insurance requirements, and protect the safety and legal rights of pupils and J9 Driving.
The lawful bases relied upon are taking steps before entering into a contract, performing a contract, complying with legal obligations, and legitimate business interests. Where health or disability information is provided, it is handled only where necessary and with your explicit consent unless another lawful reason applies.
Who information may be shared with
Information is not sold. It may be shared only where necessary with service providers supporting the website, email or business administration; payment providers; the DVSA or an examiner when relevant to a test; insurers, professional advisers or authorities where required by law or needed to establish or defend legal rights.
Some service providers may process information outside the UK. Where this happens, appropriate legal safeguards are required.
How long information is kept
- Enquiries that do not become lessons: normally up to 12 months after the last contact.
- Pupil agreements, lesson, progress, communication, test and safety records: normally up to six years after the last lesson, where needed for legal, insurance or business purposes.
- Financial and accounting records: normally six years, in line with record-keeping obligations.
- Health or fitness-to-drive information: only for as long as it is genuinely needed, normally deleted within 12 months after tuition ends unless it must be retained for a legal or insurance matter.
- Technical and security records: normally up to 12 months unless needed to investigate an incident.
Information may be kept for longer where the law requires it or where it is necessary for an active complaint or legal claim.
Your rights
Depending on the circumstances, you may ask to access, correct, delete or restrict the use of your information, object to its use, or receive a copy in a portable format. Where consent is relied upon, you may withdraw it at any time.
To make a request, contact J9 Driving using the details above. You may also complain to the Information Commissioner’s Office.
